§ 01The Service

Faint is a local-first, digital specialty coffee tasting journal available via our mobile applications and our website (faint.coffee). It provides tools such as an AI-powered scanner to extract data from physical coffee cards, a manual entry flow to build custom cards, a digital vault for logging tasting verdicts, and mapping features to track coffee origins.

§ 02Privacy & Data Storage

Your privacy is fundamental to Faint's design. As a local-first application, whether you use the AI scanner or input details manually, your tasting cards, flavor notes, photos, and personal logs ("User Content") are stored strictly on your device. We do not store your User Content on our servers.

§ 03Accounts

Faint does not require an account to use. Your journal is stored on your device. You are responsible for the security of the device on which the app is installed.

§ 04Subscriptions & Faint Pro

Faint offers a freemium model. Upon downloading the App, users are granted a limited number of free AI scans (currently 3 free scans) to test the core functionality.

Faint Pro:

To unlock additional capabilities, you may purchase an auto-renewing subscription ("Faint Pro") through the Apple App Store, the Google Play Store, or on the web at faint.coffee. Web purchases are sold by our reseller and merchant of record, Paddle.com Market Ltd ("Paddle"), through a checkout provided with RevenueCat; Paddle's own terms apply to those orders.

• Billing: Payment is charged at the confirmation of purchase — to your Apple ID or Google Play account for store purchases, or by Paddle to the payment method you enter at checkout for web purchases. Paddle applies any sales tax or VAT due where you live.
• Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• Management & Cancellation: We do not hold your payment information. Store subscriptions are managed, and auto-renewal turned off, in your Apple App Store or Google Play Store account settings. Web subscriptions are managed and canceled through Paddle's customer portal, linked from your receipt email.
• Refunds: Refund requests for store purchases must be made to Apple or Google, subject to their respective terms and conditions. For web purchases, refunds are handled by Paddle under its refund policy — write to hello@jdgarita.dev or use the link in your receipt email.
• Activating a web purchase: After a web purchase we email you a one-time link. Faint Pro is attached to the installation of the App that opens that link, so open it on the phone you use Faint on. A link that has expired is re-issued to the same email address automatically.

§ 05User License & Restrictions

We grant you a personal, worldwide, royalty-free, non-assignable, non-exclusive, revocable, and non-sublicensable license to access and use Faint for your personal, non-commercial use, subject to these Terms.

You agree not to:

• Modify, decompile, reverse-engineer, or disassemble the App.
• Use the App for any illegal, harmful, or unauthorized purpose.
• Attempt to bypass or manipulate the subscription model or scan limits.
• Reproduce, duplicate, or copy any of the App's UI, design, or intellectual property without our express written permission.

§ 06User-Generated Content & Social Sharing

Faint allows you to export and share your generated tasting cards to third-party social media platforms or other external services. You retain all rights to your User Content. By utilizing the export features, you acknowledge that Faint is not responsible or liable for the content you choose to publish, the text you attach to those posts, or the privacy practices of the third-party platforms where you share your cards.

§ 07Intellectual Property

All rights, titles, and interests in and to the App—including its design, artificial intelligence prompts, codebase, text, graphics, and logos—are the exclusive property of Juan Diego Garita Segura and are protected by international copyright and intellectual property laws.

§ 08Disclaimer of Warranties

FAINT IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESSED OR IMPLIED, REGARDING THE APP'S ACCURACY, RELIABILITY, OR AVAILABILITY.

Because Faint relies on on-device storage, you are solely responsible for backing up your device. We do not guarantee that your User Content will be preserved if you lose your device, uninstall the App without a backup, or experience hardware failure. Furthermore, while our AI scanner is designed to be highly accurate, we do not guarantee the flawless extraction of text from every physical tasting card.

§ 09Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL JUAN DIEGO GARITA SEGURA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OR INABILITY TO USE THE APP.

§ 10Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Costa Rica, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts located in Costa Rica.

§ 11Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last Updated" date at the top of this document or by providing notice within the App. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.
